The Constitutional Court which also doubles as the Court of Appeal is set to decide on Kabaka Ronald Muwenda Mutebi’s protest against the prayers made by his subject lawyer Kassim Male Mabirizi who wants to access and inspect his juicy bank accounts and other confidential Buganda Kingdom documents he signed with President Yoweri Kaguta Museveni and the status of the Official Mailo land in Buganda.

theGrapevine has exclusively seen a letter dated 2nd April 2024 which was received by the Attorney General’s chambers, K&K Advocates, lawyers representing Kabaka Mutebi in his Official capacity as a corporation sole culture leader of Buganda and S&L Advocates, the lawyers representing Kabaka Mutebi in his personal capacity as Ronald Muwenda Mutebi the son to late Sir Edward Walugembe Mutesa.

In the said letter, Mabirizi claimed that he was going to use the documents to argue out his case against the respondents given that they are instrumental in helping court deliver justice in his petition.

Among the documents Mabirizi listed to be given to him by Kabaka’s lawyers include; the certified copy of the 2013 Memorandum of Understanding signed between Kabaka Mutebi and President Museveni.

He also wants to be given up to date particulars of all land leases, sub leases, licenses and other dealings between the office of Kabaka of Buganda and himself as Ronald Mutebi and his personal companies where he has interests and shares.

Mabirizi also wants Kabaka to give him documents showing the particulars of all payments so far made to his office as Kabaka of Buganda including bank transfers and statements pursuant to the 2013 Memorandum of Understanding.

He wants to also access all the payments so far made to Kabaka Mutebi by settlers on the official mailo land returned to him by President Museveni’s government in 1993.

Mabirizi also wants the Attorney General Kiryowa Kiwanuka who is also a senior partner at K&K Advocates who he wrote to in his official capacity as the Attorney General of Uganda to reveal to him certified copies of the parliament plenary attendance lists for Members of Parliament present during the debate and passing of the Land Act 1998.

He wants to be given the parliament plenary proceedings (Hansard) leading to the Land Act 1998 as passed, the parliamentary plenary proceedings (Harsard) that led to the Land (Amendment) Act 2010 and a certified copy of the Memorandum of Understanding signed in 2013 between the government of Uganda and Kabaka Mutebi.

He also wants up to date particulars of all the properties so far returned to Kabaka, all payments and bank statements so far made to Kabaka as a result of the signed agreement.

Mabirizi also wrote to Kabaka Mutebi’s other lawyers of S&L Advocates who are representing him in his personal capacity to reveal to him the bank statements of their client.

However, Mabirizi confirmed that Kabaka’s lawyers of K&K Advocates through their senior partner Edwin Karugire who is also a personal lawyer and a son-in-law to President Museveni confirmed to him that they are not going to give him the documents he asked for because he has no legal bearing in his petition.

“Now I’m waiting for a response from the Attorney General because he is also a party in my petition and Kabaka’s personal lawyers of S&L Advocates. If they decline to reveal the documents I ask for, I will proceed with the application before the Court so that they force them to do so,” Mabirizi said.

He boasted that he is not threatened with Karugire’s actions because there are a number of authorities which he will rely on to convince the Justices of the Constitutional Court to force them to give him the documents he wants.

Mabirizi further wants Kabaka Mutebi, his former cultural, palace and security minister and also the former Chief Executive Officer of Buganda Land Board  (BLB) David Kiwalabye Male, Baker Ssejjengo an employee of BLB, Bashir Kizito Juma the Deputy BLB Chief Executive Officer to be cross examined.

He claims that Kizito and Ssejjego helped Kabaka to mismanage Buganda Kingdom properties and a number of them are registered in his personal names and companies.

He further alleges that Kabaka Mutebi’s BLB used force to violate settlers on the official mailo while the government looked on.

He wants court to declare that president Museveni illegally signed the 2013 Memorandum of Understanding with Kabaka Mutebi.

He further wants the five justices of the constitutional court to declare that Kabaka Mutebi is not the owner of Buganda Kingdom official mailo land but just a trustee.

Kabaka and other parties denied all the allegations Mabirizi placed against them and asked court to dismiss his petition with costs.

Court set 1st June, 2024 as the date to kickoff the process of scheduling the matter before it is taken to the five justices who will determine it.

INSIDE STORY: How M7 Grilled CMI Boss After His Wealth Shocked Him…

    Published

    on

Before President Yoweri Kaguta Museveni made the latest changes in the top command of military intelligence agency where he changed from the Chieftaincy of Military Intelligence (CMI) to Defence Intelligence and Security (DIS), he was shocked at how one of the top commandant was accumulating a lot of wealth in a very short period.

Kira Municipality legislator Ibrahim Ssemujju Nganda recently revealed that Museveni was shocked recently while driving in a certain part of the country when he saw a mega farm sitting on land measuring more than one and half square miles.

Ssemujju narrated that the farm was newly established with modern equipment and thousands of very expensive breeds of cattle which forced him to ask his private operatives to investigate which tycoon owned the farm

He was shocked to learn that one of the CMI commandants is the owner of the farm.

Ssemujju disclosed that immediately, Museveni summoned the said CMI boss and quizzed him on where he got all the money he used to establish the said modern farm at his young age.

Ssemujju explained that Museveni was very bitter with the said senior operative and accussed him of mismanaging public funds which are supposed to be used in gathering information to protect the country and its citizens.

He added that because the seasoned operative was aware that before Museveni summoned him, he had made thorough investigations and was equipped with information, he decided to tell him the truth to survive.

The senior operative told the President how he got the billions he used to buy the land, compensate the tenants who were occupying it, modernizing it and buying high breed cows from a Chinese.

“He told him that he got the man from a Chinese investor. The president is very aware that most of his government officials get rich from getting bribes from investors and other corruption deals. So don’t be deceived that he can fight corruption because even in the case of that military officer, he left him to go without directing any prosecution against him,” Ssemujju said while appearing on Radio Simba’s Olutindo program hosted by senior political journalist Peter Kibazo.

On several occasions, Museveni has disclosed that that he knows how his government officials are getting bribes from Chinese investors.

Ssemujju explained that when Museveni’s government officials get information that a certain person is deployed in an office which is well facilitated with billions money, they make sure that they fight him and that is what they did to former Prime Minister John Patrick Amama Mbabazi, former Inspector General of Police Gen. Edward Kale Kayihura and others because they controlled fat budgets.

He revealed that even with the ongoing political turmoil against Annet Anita Among, there might be government officials fueling her troubles because she had become a threat to their political careers much as there are those also who want to be speakers of parliament.

He confirmed that like Mbabazi and Kayihura, Among is currently the second most powerful person in the country next to President Museveni which has fetched her trouble.

“They only fear Gen. Salim Saleh because he is a brother to Museveni but if it was not so, he would have also been fought like Kayihura, Mbabazi and others,” Ssemujju said.

He made the statements days after the United Kingdom, United Arab Emirates issued sanctions against Among on allegations of corruption.

President Museveni directed the Attorney General Kiryowa Kiwanuka to follow up the allegation and force the United Kingdom government to provide evidence.

The Office of the Inspector General of Government confirmed that Among did not declare the alleged properties in the United Kingdom and United Arabs Emirates.

Among also assured the country that she owns nothing in the foreign countries claiming that western countries are targeting her because of the Homosexuality law.

Lawyer Steven Kalali (R) and High Court judge Alexandra Nkonge Rugadya (L)

Controversial lawyer Steven Kalali has clashed with High Court judge Alexandra Nkonge Rugadya over a Court Case File.

The disagreement resulted from Kalali’s prayer where is was asking the presiding officer not to kick off his case because she was not going to conclude his entire case.

He submitted that Justice Nkonge is set to retire early this year and the time she has left in public service is to clear the cases on her desk not to get fresh files like his.

However, the judge disagreed with Kalali insisting that she has to hear the matter at all cost which forced Kalali to threaten to file a recuse application against her.

This is not the first time that a retiring judge feel bad when asked to leave the matter to another judge because of their remaining time in the public service.

Justice Joseph Mulangira faced off with lawyers led by Arthur Ssempebwa of Katende Ssempebwa and Company Advocates in the divorce case filed by city Pastor Aloysious Bujjingo of House of Prayers Ministries International against their client Teddy Naluswa Bujjingo.

Justice Wilson Musane Musene was forced by the principal judge to hand over the office and officially go into retirement.

Queen Nagginda On Spot As Top M7 Adviser Questions Her Behaviour At A Time When Her Husband Kabaka Mutebi Needs Her Most…

    Published

    on

Queen Sylvia Nagginda Luswata with Kabaka Ronald Muwenda Mutebi

Queen Sylvia Nagginda Luswata is on the spot after President Yoweri Kaguta Museveni’s Senior Presidential Advisor on media Joseph Tamale Mirundi questioned her relationship with Ronald Muwenda Mutebi the Kabaka of Buganda.

Mirundi accuses Nagginda of abandoning Kabaka Mutebi at the time he needs her most.

“Every married man knows that when he gets sick, he wants his wife to be close to him. But since Kabaka Mutebi got sick, I have never seen a photo of him with his wife comforting him. I’m sure her distance from the king is sending a message to Baganda,” Mirundi said.

He added that if Nagginda as the official wife was performing her duty to take care of her husband as she vowed when they were officially getting married in church, Baganda would not be raising questions over his whereabouts because they would know that she is in the right hands.

Mirundi explained that Baganda would have believed any message communicated from Nagginda than any other person including Buganda premier Charles Peter Mayiga.

“Baganda are not stupid people. They know that their king is a human being who can get sick but they got annoyed when Mayiga told them that their king was suffering from Allergy.

But what I can assure Mayiga and Nagginda is that if anything bad happens to Kabaka, they will be blamed first because his life is in their hands. I know what Kabaka means to Baganda,” Mirundi warned.

He wondered how Nagginda organized a colourful ceremony to launch her book without the blessings of her husband, and even though most members of the Royal family shunned he launch, she remained unapologetic.

She did not stop at that, she is on a fundraising drive to get money to help the mentally sick get proper medical treatment without the blessing of the King.

However, Buganda Kingdom historian, Mubiru Njuuki rubbished Mirundi’s allegations explaining that in Kiganda culture, Nagginda as the official wife to the king is not responsible for comforting the King when get sick.

He explains that people like Omuttaka Kasujju the clan head of Engeye, omuttaka Mugema the clan head of Ekima, Kasujju Lubinga and Nadduli Kibale are the ones answerable.

He added that it is not the first time Baganda are putting the King’s wife on spot when he is troubled. He gave the example of Damalie Kisosonkole the official widow to Sir Edward Walugembe Mutesa, father to King Mutebi who was blasted for putting on sunglasses when she was accompanying the body of her husband from United Kingdom where he died from.

“You know our people love their king so much, they wanted her to start crying on top of her voice as soon as she came out of the plane. You know because Damalie was a modern wife, and when she put on sunglass, people accused her that she was not hurt by the King’s death that is why she was only enjoying her fashion style,” Njuuki said.

He added that when Drussila Namaganda the widow to Sir Daudi Chwa remarried after the death of her husband because she was still younger, and her son King Muteesa allowed her to get marriage to another person, Baganda turned guns on her and her new husband and they were badly hated in Buganda.

Njuki accused Premier Mayiga of mismanaging Kabaka’s sickness thinking that it will make him more powerful.

He says that little did Mayiga know that he was creating troubles for himself because if anything bad happens to Kabaka, he will be on spot and the most hated man in Buganda.

However recently, photos of Kabaka leaked on social media with his brother Joseph Ndawula and the Kingdom minister Kitooke revealed that he is in Namibia resting after being released by doctors in Europe.

But highly placed sources in the palace insist that Kabaka Mutebi returned back into the country a few weeks back and the said photos were taken in Uganda.

Sources insist that prince Ndawula who is a brother to King Mutebi has been in the country enjoying life with his longtime friend Godfrey Kirumira the Namibian consular in Uganda.

Since 2019, Kabaka Mutebi has been receiving medication.
