Al-Hajji Faruk Kirunda, the deputy press secretary has revealed that his boss president Yoweri Kaguta Museveni has been briefed on the facts concerning the ongoing fights over the ownership of Katanga land in Kawempe Division a Kampala suburb.
Kirunda revealed that the State House Legal Department intervened after the disputes turned into a security concern in the area.
On 31st May, 2023 and 8th June, 2023, the State House Legal Department summoned meetings to ascertain allegations made by Dr. Ntwatwa Ssekiziyivu Lule that the land belongs to him.
The meeting was attended by; Representatives from Makerere University, Pastor Walugembe was represented by his lawyers, the representatives of the bibanja holders Chairperson of the area, the Resident City Commissioner Kawempe (RCC), Division Police Commissioner (DPC) Wandegeya, chairperson of bibanja, Dr. Ntwantwa and all local chairmen of the area.
According to the information obtained by theGrapevine, Dr. Ntwatwa claims that he gave powers of Attorney to Stuart Mulangira Katerega to keep his land.
Using these powers of attorney, Katerega signed a tenancy agreement with the late Doreen Ainomugisha for an initial period of 12 years at Shs.20,000,000 per month.
The meeting observed that another agreement was signed between Mulangira, Ainomugisha and Bob Semakula on 11th May, 2018 and they became business partners.
In May 2021, when Doreen died, the business was left with Bob Semakula but Albinos Assimwe was given powers of attorney to manage the late’s properties.
Semakula told the meeting that he faced several challenges with the deceased’s family which led to the business failing and he accumulated arrears with the landlord.
After two years of defaulting, Dr. Ntwatwa terminated the tenancy and brought Sheila Karungi and Richard Kajungu on board.
Because Asiimwe had secured the powers of Attorney to Administer Ainomugisha’s properties, he challenged the landlord’s actions in the high court including his alleged ownership of the land.
He also sought compensation for damages for obtaining money by false presence.
At the end of the meeting, a number of resolutions were made but most importantly, they were instructed that the issues of the former tenants and the landlord be resolved outside the premises being managed by Karungi and Kajungu.
A resolution was issued warning Asiimwe not to step on the premises of the contested kibanja.
He was cautioned that if seen, or his agents, they will be arrested by police. The meeting also resolved that the local authorities should wait for the determination of the case before court.
However, Hajji Abdul Nadduli, the Special Presidential Advisor on political affairs accused Statehouse of biasness.
In his petition, Nadduli informed the president that he was approached by Walugembe complaining about State House Legal Department meeting resolutions dated 13th June, 2023.
Nadduli informed the president that in 1997, he held a meeting with bibanja owners in Katanga valley who are now deceased.
They included; Jonathan Masembe, De Blasio Buyise Kalimu and Samalie Namboga, pastor Walugembe was present in the meeting.
Nadduli stated that the deceased told him in the meeting that they owned 38 acres of bibanja land but later sold 15 acres to Walugembe.
They gave him a copy of the sales agreement as evidence.
Nadduli further explained that in 2000, before his death, the deceased filed a suit in the High Court against Makerere University which was determined in 2015 in favor of the plaintiffs declaring them bonafide occupants.
Nadduli said that after the determination of the case, Walugembe set up a church and businesses but his kibanja was encroached on by land grabbers claiming that they also bought the land from the same people.
He noted that Walugembe told him that he instituted a suit against the encroachers which later led to a consent judgment.
But in 2017, over 100 people led by Dr. Ntwatwa also filed a suit in court challenging the consent judgment.
He added that in November 2021, their suit was dismissed with costs which and this ruling has not yet been appealed.
He accused Dr. Ntwatwa of misleading and giving false information to various public offices which include; Uganda Police Force, Minister of Lands, Attorney General, State House Anti-Corruption Unit.
He requested that after failing to resolve the dispute legally, he wants President Museveni to intervene.
