Vital exhibits in the murder case where city tycoon Muhammad Sebuufu and proprietor of pine car bond is still missing.  Michael Ojok the state prosecutor revealed to High Court Judge Flavia  Angelin  Senoga that prosecution is still looking for the phones which were allegedly used by the suspects on the day the late Donny Betty Katushabe was murdered

“My lord the exhibits especially phones were closed inside the office of Mr. Richard Ndaboine the former cybercrime commandant who was arrested by CMI. We are still pleading with CMI to allow us open Ndaboine’s office and we remove those phones and other exhibits,” Ojok said.

Ojok submitted that the phones in question are very important exhibits in this case because the suspects allegedly used them to communicate how to commit the crime. Ojok asked the judge to add them more time to get them. This is the second time that the state is asking for more time to produce these exhibits. The judge added them more time and adjourned the matter up to 9th -08 2018.

The judge also set the same day to make her ruling on whether to allow the state to rely on photocopies of the exhibits recorded by the chief investigator in this murder case. Sebuufu’s lawyers led by Caleb Alaka challenged the photocopy of the exhibits brought to court. “My lord we are not sure whether these exhibits lists are not forged from Nasser Road. We pray that this court forces the prosecution to bring the original copies,” Ochange Evans, one of Sebuufu’s lawyers submitted.

However, Ojok told court that they were given only photocopies from the National Laboratory centre Wandegeya and they were told that technicians can’t give them original copies.  He further submitted that the documents brought to court by Detective AIP Henry Peter Warya are authentic because they bear the laboratory stamp.

Warya who led the team of investigators from police who were working on this matter told court that he collected a lot of exhibits including blood samples which were tested from the lab. He indicated that blood found in Sebuufu’s offices matches that of the late Katushabe.

The State alleges that Muhammad Sebuufu, Godfrey Kayiza, Phillip Mirambe, Steven Lwanga and others killed Katushabe after she failed to clear the balance of nine million from the car she purchased from Sebuufu’s car bond

Kirumira Murder Investigation:  Until His Death, Museveni Wasn’t Aware That Slain Cop Was Detained At Nalufenya During Kayihura Tenure

Published

on

President Museveni has said that he was not aware of the detention of slain Buyende District Police Commander (DPC) Muhammad Kirumira at Nalufenya.

In a meeting with president Museveni at Nakasero state lodge, the executive members of late Muhammad Kirumira‘s Nalufenya torture victims group were shocked after the president revealed that he never knew that Kirumira was at one time arrested  and detained at Nalufenya during general Kale Kayihura’s tenure as Inspector General of Police (IGP).

Led by Rt. Maj Godfrey Galabuzi  Musisi,  the group had met the president to hand in another report  on why the slain cop was at war with his superiors in the police force and why he might have been killed.

According to a source who also attended the meeting, Museveni said that until this meeting, he has not been aware that Kayihura sent Kirumira to Nalufenya police detention centre which is now Nalufenya police station.

“On receiving the report with the signature of the late Kirumira as the chairman, M7 asked Maj Galabuzi if indeed Kayihura had taken Kirumira to Nalufenya.

He even called Maj Gen. Proscovia Nalweyiso to cross check and Nalweyiso answered in the affirmative,” a source said.

The group that met the president in late hours also included BK Bukenya who was arrested by police and displayed by the then IGP Gen Kale Kayihura  as the man who was behind the rampant panga attacks and killings also known as ‘Bijambiya’ before he was later cleared by ISO and other security groups for being arrested in error.

During this meeting, it’s said the Commander in Chief also promised security to the Nalufenya team who felt that their lives were in danger.

We were also told that the president cleared those with military background to get armed if they so wished to boost their security.

Just like former police spokesperson Andrew Felix Kaweesi, Kirumira was also assassinated a few meters from his home.

Farouq Kaweesa, a brother to the late Kateregga through his lawyer Ladislaus Rwakafuzi stated that Kateregga was assassinated in cold blood by members of UPDF who were in uniform. In his affidavit, Kaweesi stated that on 5th October 2018, UPDF operatives found Kateregga at his home in Luyinja Namungoona Rubaga Division and shot him without a warning. He further stated that it was UPDF which Muhoozi commands that intentionally caused the death of Kateregga who was not on death sentence pronounced by a competent court.

He noted that the killing was violent and unnatural and therefore, is a subject of an inquest under the inquest Act. Kaweesa wants court to instruct the internal Affairs minister Jeje Odongo to appoint a coroner to inquire into the lawfulness of the death of his brother.  He also wants court to issue a Habeas corpus against General Muhoozi to produce a One Mariam Kateregga.

He stated that on the day UPDF killed his brother, the same killers who were putting on UPDF uniforms also kidnapped Mariam Kateregga a wife to Kateregga. He said that Mariam was found at his home in Luyinja Namungoona Rubaga Division where they killed her husband from. He said that from that day up to now the family of Mariam has never seen or heard of her whereabouts which violates her human rights.

He stated that he was informed by his lawyer Rwakafuzi that it’s illegal and unconstitutional for any person to be detain the other in un gazette custody and asked court to order Muhoozi to produce Mariam before a competent court because she has never appeared before any judge or magistrate as stated in the constitution.

He said that Mariam left 15 children, 13 of them are her biological children and 2 are for her co-wife. He added that the children are still too young because the oldest is 17 years while the youngest is 2 years and they don’t have anybody to take care after them.  Court has not yet set a date to hear the application. Kateregga was killed by CMI operatives as he allegedly tried to run away from being arrested. President Museveni later congratulated Katerega’s killers and revealed that he masterminded the brutal murder of former Buyende district Police Commander (DPC) Afande Muhammad Kirumira and a lady friend in Bulenga Wakiso district last month.
